How to File an Objection to a Prevailing Wage Determination

By March 10 of each year, the Division of Labor Standards issues an annual wage order, which contains an initial wage determination for wages to be paid on public works projects for each craft in each locality in the state. By July 1 of each year, the Division issues a general wage order, which contains a determination applicable to every locality for the Missouri State Highways and Transportation Commission. Any affected person may file an objection in writing to the Labor and Industrial Relations Commission within 30 days of the filing of those determinations with the Secretary of State.

The Commission will set a hearing date within 30 days and conduct the hearing within 60 days of the receipt of the objection. At any time before the hearing, any person affected by the final determination may intervene in the proceedings. The Commission will then issue its order within 20 days after the conclusion of the hearing. The order may be appealed by filing a petition in the appropriate Missouri circuit court. The venue for this petition is, at the option of the plaintiff, in the circuit court of Cole County, the county of the plaintiff or one of the plaintiff's residence. If a plaintiff is a corporation they may also choose the circuit court of the county of the corporation's registered office or business office as the venue for the petition.
