Objection filed April 10, 2000, by Western Missouri and Kansas Laborers District Council, to Annual Wage Order No. 7, pertaining to the wage rate for the occupational titles of Laborer (Building) General, First Semi-Skilled, and Second Semi-Skilled in Section 006 – Barton, Section 008 – Benton, Section 015 – Camden, Section 031 – Daviess, Section 041 – Harrison, Section 043 – Hickory, Section 065 – Mercer and Section 071 – Morgan Counties, Missouri, (Objection Nos. 25-27, 29-33); and pertaining to the wage rate for the occupational title of Laborer (Building) Second Semi-Skilled in Section 020 – Cedar County, Missouri, (Objection No. 28) issued by the Division of Labor Standards, Department of Labor and Industrial Relations; filed with the Secretary of State:  March 10, 2000.

                                                                                                                                                           

 

 

On April 10, 2000, Western Missouri and Kansas Laborers District Council (Objector) filed the above‑referenced objections to Annual Wage Order No. 7 with the Labor and Industrial Relations Commission (Commission).  The hearing had been set for May 10, 2000.

 

On April 27, 2000, Objector and the Division of Labor Standards (Division) filed with the Commission a Stipulation of Fact with regard to Objection Nos. 25-33.  As to Objection Nos. 25-27, 29-33, the Division and Objector have agreed with respect to what wage rates should be paid for the occupational titles of Laborer (Building) General, First Semi-Skilled, and Second Semi-Skilled in Barton, Benton, Camden, Daviess, Harrison, Hickory, Mercer and Morgan Counties.  The Commission received no other objections with respect to the wage rates for the occupational titles of Laborer (Building) General, First Semi-Skilled, and Second Semi-Skilled in those counties.  No Motion to Intervene has been filed with respect to Objection Nos. 25-27, 29-33. 

 

As to Objection No. 28, the Division and the Objector have agreed with respect to what wage rates should be paid for the occupational title of Laborer (Building) Second Semi-Skilled in Cedar County.  The Commission received no other objections with respect to the wage rates for the occupational title of Laborer (Building) Second Semi-Skilled in Cedar County. 

 

On May 4, 2000, the Commission granted the City of Eldorado Springs’ (Intervenor) request to intervene in Objection No. 28.  On May 9, 2000 Intervenor moved to withdraw its request to intervene in Objection No. 28.  That motion to withdraw is granted.

 

The wage rates to which the Division and Objector are agreeing are reflected in the Stipulation of Fact, which is attached to this Order.

The Commission accepts the hourly rates and fringe benefits reflected in the Stipulation of Fact.  The Commission orders that the rates set forth in the attached Stipulation of Fact are the prevailing rates for the crafts listed.  Objection Nos. 25-33 are dismissed.
