ORDER
OF COMMISSION
Objections
filed April 10, 2000, by the International Association of Heat Frost Insulators
and Asbestos Workers, Local Union 63, AFL-CIO, (Objection #42, 43, 44) to Annual
Wage Order No. 7, Camden County, Missouri (Section 015), Jasper County,
Missouri (Section 049), and Barton County, Missouri (Section 006), issued by
the Division of Labor Standards, Department of Labor and Industrial Relations
and filed with the Secretary of State:
March 10, 2000.
On April 4, 2000, objections to the above‑referenced
Annual Wage Order were filed on behalf of the International Association of Heat
Frost Insulators and Asbestos Workers, Local Union 63, AFL-CIO (Objector), with
the Labor and Industrial Relations Commission (Commission). A hearing in the matter had been set for May
11, 2000. A pre-hearing was scheduled
for May 1, 2000 at 9:00 a.m. and was convened at that time. Present at the pre-hearing were
representatives for the Objector and the Division.
On April 24, 2000, hth companies, inc., by counsel, filed a
motion to intervene. That motion was
accepted by the Commission. On May 1,
2000, the intervenor did not appear at the pre-hearing. By conference call, intervenor’s counsel
Stephen P. Schuster stated that the intervenor was withdrawing its motion. The oral motion to withdraw was granted by
the Commission’s authorized representative.
The Objector and the Division then submitted a stipulation settling the
disputes in this matter.
The Division and the Objector have agreed to the wage rates
that should be paid to “Asbestos Worker” in the affected counties. The Commission received no other objections
with respect to the wage rates for Asbestos Worker in Camden, Jasper or Barton
Counties and has received no motion to intervene other than the one withdrawn
by hth companies, inc. The wage rates
to which the parties are agreeing are reflected in the stipulation that is
attached to this Order.
The Commission accepts the rates and fringe benefits
reflected in the stipulation and orders that the rates set forth in the
attached stipulation are the prevailing rates for the craft listed. The Objections are dismissed.
