Statute of Limitations for Private Right of Action for Prevailing Wages

Senate Bill 420 recently signed by the Governor amended section 516.130 RSMo to establish a three (3) year statute of limitations for workers to pursue a private right of action. Suits to collect unpaid wages due workers for work performed on a Missouri public works project are permitted by Section 290.300 RSMo. The new law will go into effect August 28, 2005.
