Commission on Human Rights Orders School to Pay $10,000 in Disability Case

JEFFERSON CITY, MO - The Missouri Commission on Human Rights (MCHR) ordered Brookside Charter School in Kansas City to pay $10,000 after finding the school had discriminated against a student because of her disability.

In the case heard by the Administrative Hearings Commission last month, the MCHR charged that Brookside Charter School failed to reasonably accommodate the student’s disability despite her parents’ repeated requests.  The student was awarded $10,000 and the school was ordered to cease and desist from further discriminatory practices.

“The evidence revealed the school could have easily accommodated the student, but chose not to do so,” said Eric Krekel, acting executive director of the MCHR.  “Schools have an obligation to reasonably accommodate the disabilities of their students.”

The MCHR is responsible for enforcing the Missouri Human Rights Act which prohibits employment discrimination because of race, color, religion, national origin, ancestry, sex (including sexual harassment and pregnancy), disability and age (in employment only) and familial status (in housing only). Further information about the MCHR is available on its website at www.dolir.mo.gov/hr or by calling (573) 751-3325.
