How to Report Workers' Compensation
Fraud and Noncompliance

Any person may file a complaint alleging fraud or noncompliance with the Fraud and Noncompliance Unit by calling 800-592-6003. All investigations conducted by the FNU are strictly confidential. Due to the confidential nature of FNU investigations, persons lodging complaints are not provided information on the outcome of the investigation prior to prosecution. The complaint is then referred to the FNU in order to investigate and present findings of fraud and noncompliance to the director of the Division of Workers' Compensation. The director may refer the case to the Missouri Attorney General for prosecution.

Any person convicted of filing a false workers' compensation claim or submitting a false/forged certificate of insurance shall be guilty of a class D felony and liable to Missouri for a fine not to exceed $10,000 or double the value of the fraud, whichever is greater. All other claim violations in Chapter 287.128 shall be guilty of a class A misdemeanor and liable to Missouri for a fine not to exceed $10,000 or double the value of the fraud, whichever is greater. Any employer failing to insure their liability is guilty of a class A misdemeanor and is liable to Missouri for penalty in an amount of up to three times the annual premium the employer would have paid had such employer been insured or up to $50,000, whichever is greater. A second violation of the workers' compensation laws is a class D felony. New laws that take effect on August 28, 2005 are: submitting a false/forged certificate of insurance and providing false information to an investigator of the Fraud and Noncompliance Unit.

Any fines or penalties levied and received as a result of prosecution under this law shall be paid to the Workers' Compensation Fund. Any restitution ordered as part of the judgment is paid to the persons who were defrauded. The FNU does not settle claims or pay benefits.
